1. Acceptance of Terms

By engaging TuneMax Chennai for automotive tuning and customization services, you agree to be bound by these Terms of Service and all applicable laws and regulations. These terms constitute a legally binding agreement between you (the customer) and TuneMax Chennai (the service provider). If you do not agree with any part of these terms, you should not use our services.

These terms apply to all services provided by TuneMax Chennai, including but not limited to performance tuning, custom bodywork, paint services, suspension modifications, interior customization, and related automotive services. Your acceptance of these terms is indicated by your signature on service agreements, payment for services, or verbal consent during consultation.

We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website or notification to customers. Continued use of our services after changes indicates acceptance of the modified terms. We recommend reviewing these terms periodically to stay informed of any updates.

2. Service Descriptions and Scope

TuneMax Chennai provides professional automotive tuning and customization services for various vehicle types including cars, motorcycles, and commercial vehicles. Our services include but are not limited to ECU remapping, performance upgrades, custom bodywork, paint and finishing, suspension modifications, interior customization, and related automotive enhancement services.

All services are provided based on detailed consultations and written agreements that specify the scope of work, parts to be used, estimated completion timelines, and total costs. Any modifications to the agreed scope of work must be approved in writing and may result in additional charges and extended completion times.

We reserve the right to refuse service for any vehicle that we determine is unsafe, illegal, or beyond our technical capabilities. We also reserve the right to recommend alternative solutions if the requested modifications are not technically feasible or would compromise vehicle safety or reliability.

3. Customer Responsibilities

Customers are responsible for providing accurate and complete information about their vehicle, including modification history, current issues, and specific requirements. Any false or misleading information may affect service quality and void warranties. Customers must disclose any previous accident damage, electrical issues, or ongoing problems that may affect the proposed modifications.

Customers must ensure their vehicle is delivered to our facility in clean condition and remove all personal belongings before service begins. TuneMax Chennai is not responsible for any personal items left in vehicles during service. Customers should also ensure their vehicle has adequate fuel and proper fluid levels unless specifically arranged otherwise.

Payment terms must be followed as specified in service agreements. Customers are responsible for understanding and complying with all applicable laws and regulations regarding vehicle modifications in their jurisdiction. TuneMax Chennai provides guidance but customers bear ultimate responsibility for legal compliance of their modified vehicles.

4. Pricing and Payment Terms

All pricing is provided in written estimates and is subject to change based on scope modifications, parts availability, or unforeseen complications discovered during service. Final pricing will be confirmed before any additional work is performed beyond the original scope. Estimates are valid for 30 days unless otherwise specified.

Payment terms vary by project size and complexity. Typically, a deposit is required to begin work, with final payment due upon completion. For large projects, progress payments may be scheduled throughout the work period. All payments must be made in the currency specified in the service agreement and through approved payment methods.

Late payment fees may apply to overdue accounts as specified in service agreements. TuneMax Chennai reserves the right to retain completed vehicles until full payment is received. Additional storage fees may apply for vehicles not collected within the agreed timeframe after completion notification.

5. Warranties and Guarantees

TuneMax Chennai provides warranties on workmanship and certain parts as specified in individual service agreements. Warranty periods vary depending on the type of service performed and parts used. Our workmanship warranty covers defects in installation and tuning services but does not cover normal wear and tear, misuse, or damage caused by factors outside our control.

Parts warranties are typically provided by the manufacturer and may vary in duration and coverage. We will assist customers with warranty claims but do not guarantee manufacturer warranty approval. Some performance modifications may affect original manufacturer warranties, and customers will be advised of potential implications before service begins.

Warranty coverage is void if the vehicle is modified by other parties after our service completion, if the vehicle is used in competitive racing without prior notification, or if recommended maintenance procedures are not followed. All warranty claims must be reported promptly and may require inspection at our facility.

6. Limitation of Liability

TuneMax Chennai's liability for any service-related issues is limited to the cost of correcting defective work or replacing defective parts covered under warranty. Under no circumstances will our liability exceed the total amount paid for the specific service in question. We do not accept liability for consequential damages, lost profits, or indirect costs related to vehicle downtime.

Customers acknowledge that automotive modifications carry inherent risks and that performance modifications may affect vehicle reliability, fuel economy, emissions compliance, and insurance coverage. TuneMax Chennai is not responsible for these potential consequences, and customers assume full responsibility for the decisions to proceed with modifications.

We do not guarantee specific performance gains or outcomes as results may vary based on vehicle condition, parts quality, driving conditions, and other factors beyond our control. All performance estimates are based on typical results and should be considered approximate rather than guaranteed outcomes.

7. Insurance and Risk Allocation

TuneMax Chennai maintains comprehensive business insurance including general liability and professional indemnity coverage. However, customers are advised to verify that their vehicle insurance covers modifications and to notify their insurance provider of any significant changes. Some modifications may affect insurance coverage or premiums.

While vehicles are in our care, they are covered by our business insurance for damage caused by our negligence. However, customers retain responsibility for comprehensive and collision coverage for their vehicles. We recommend maintaining full insurance coverage throughout the service period.

Customers assume risk for any modifications that may affect vehicle safety, emissions compliance, or road legality. TuneMax Chennai provides guidance on legal requirements but customers bear ultimate responsibility for ensuring their modified vehicles comply with applicable regulations and safety standards.

8. Intellectual Property Rights

All custom tuning maps, software modifications, and proprietary techniques developed by TuneMax Chennai remain our intellectual property. Customers receive a license to use these modifications on their specific vehicle but may not copy, distribute, or reverse-engineer our proprietary work. This protects our investment in research and development.

Customers retain ownership of their vehicles and any non-proprietary modifications performed. However, any custom software, tuning parameters, or unique fabrication techniques developed specifically for a project may remain proprietary to TuneMax Chennai and may be used for future similar projects.

We respect customer privacy regarding unique vehicle builds and proprietary information shared during consultations. We may use general project information for marketing purposes but will not disclose specific technical details or customer information without explicit consent.

9. Force Majeure and Service Delays

TuneMax Chennai is not liable for delays or inability to perform services due to circumstances beyond our reasonable control, including but not limited to natural disasters, government regulations, supplier delays, equipment failures, or other unforeseen events. Such circumstances constitute force majeure events that may affect service timelines.

In case of force majeure events, we will make reasonable efforts to minimize delays and communicate with affected customers promptly. Extended delays may result in renegotiation of service agreements or mutual agreement to cancel projects with appropriate refund arrangements based on work completed.

Parts availability issues, supplier delays, or shipping problems may affect project timelines. We will notify customers of significant delays as soon as they become apparent and work to find alternative solutions when possible. Customers may choose to wait for original parts or approve substitute components where appropriate.

10. Termination and Cancellation

Either party may terminate service agreements under certain circumstances as specified in individual contracts. Customers may cancel projects before work begins with minimal cancellation fees. Once work has commenced, cancellation may result in charges for completed work, ordered parts, and reasonable cancellation fees.

TuneMax Chennai reserves the right to terminate service agreements if customers fail to make required payments, provide false information, or engage in conduct that interferes with our business operations. In such cases, customers remain responsible for services completed and parts ordered on their behalf.

Upon termination, vehicles and completed work will be returned to customers upon payment of all outstanding charges. Any proprietary tuning or software modifications may be removed or disabled at our discretion. Partial refunds may be provided based on work completed and parts that can be returned to suppliers.
